3. PROHIBITED USES
3.1 Unlawful Activities
You may not use the Service to:
- Violate any applicable local, national, or international law or regulation
- Infringe upon intellectual property rights of any third party
- Facilitate fraud, money laundering, or financial crimes
- Engage in or facilitate illegal drug trafficking or controlled substance violations
- Violate Moroccan pharmacy laws, regulations, or professional standards
- Evade taxes or engage in tax fraud
- Violate data protection laws, including Moroccan Law 09-08
- Engage in or facilitate any criminal activity
3.2 Medical and Clinical Misuse
YOU ARE STRICTLY PROHIBITED FROM USING THE SERVICE FOR:
- Providing medical advice, diagnosis, or treatment to patients
- Making clinical decisions affecting patient health or safety
- Prescribing medications or determining drug dosages
- Tracking controlled substances for regulatory compliance purposes
- Patient care documentation or clinical record-keeping
- Any purpose requiring certification as a medical device
- Substituting for professional medical judgment or expertise
The Service is solely for business operations and inventory management, not medical or clinical use.
3.3 Unauthorized Access and Security Violations
You may not:
- Access or attempt to access accounts, systems, or data not authorized to you
- Circumvent, disable, or interfere with security features or access controls
- Use automated tools, scripts, or bots to access the Service without authorization
- Probe, scan, or test the vulnerability of the Service or any related systems
- Breach or bypass authentication or security measures
- Access the Service through any means other than the official user interface
- Share your account credentials with unauthorized individuals
- Attempt to decipher, decompile, disassemble, or reverse engineer the Software
3.4 Harmful or Malicious Conduct
You may not:
- Introduce viruses, malware, trojans, worms, or other malicious code
- Launch denial-of-service attacks or flood the Service with excessive requests
- Interfere with or disrupt the integrity or performance of the Service
- Damage, disable, overburden, or impair the Service or associated infrastructure
- Engage in any conduct that could harm, disable, or interfere with other users
3.5 Data Misuse and Privacy Violations
You may not:
- Collect, harvest, or scrape personal data from the Service without authorization
- Use Customer Data for purposes other than those disclosed to data subjects
- Sell, rent, or trade personal data obtained through the Service
- Process personal data without appropriate legal bases or consents
- Violate Moroccan Law 09-08 or other applicable data protection laws
- Transfer personal data to third parties without lawful authority
- Fail to implement appropriate data security measures
- Access or use another Customer's data without authorization
3.6 Intellectual Property Violations
You may not:
- Copy, reproduce, distribute, or create derivative works of the Software
- Remove, alter, or obscure any copyright, trademark, or proprietary notices
- Use Wellys Pharma trademarks, logos, or branding without prior written consent
- Infringe upon the intellectual property rights of Wellys Pharma or any third party
- Claim ownership of or reverse engineer the Software
3.7 Resale and Unauthorized Commercial Use
You may not:
- Resell, sublicense, rent, or lease access to the Service without authorization
- Use the Service to provide services to third parties (service bureau use)
- Frame, mirror, or replicate any portion of the Service
- Use the Service for the benefit of competitors or to develop competing products
- Commercialize access to the Service beyond your authorized subscription
3.8 Abuse and Harassment
You may not:
- Harass, threaten, stalk, or abuse other users or Company personnel
- Transmit hateful, defamatory, obscene, or offensive content
- Impersonate any person or entity or misrepresent your affiliation
- Engage in spam, phishing, or unsolicited commercial communications
3.9 Content Violations
You may not use the Service to store, transmit, or process:
- Illegal, infringing, defamatory, or obscene content
- Content that violates third-party rights (privacy, publicity, intellectual property)
- Content promoting violence, discrimination, or illegal activities
- Pornographic, sexually explicit, or age-inappropriate material
- False, misleading, or fraudulent information
- Confidential information belonging to third parties without authorization
3.10 System Abuse
You may not:
- Exceed authorized usage limits or storage quotas
- Use the Service in a manner that consumes excessive system resources
- Create multiple accounts to circumvent restrictions or limits
- Engage in "scraping" or automated data extraction
- Use the Service for cryptocurrency mining or similar resource-intensive activities
- Intentionally submit false or misleading data to disrupt Service operations
3.11 Regulatory and Compliance Violations
You may not:
- Use the Service in a manner that violates Moroccan pharmacy regulations
- Fail to maintain required pharmacy licenses or permits
- Use the Service to circumvent regulatory requirements or reporting obligations
- Violate professional ethics or standards applicable to pharmacists
- Fail to comply with tax, accounting, or financial reporting requirements
4. CUSTOMER RESPONSIBILITIES
4.1 Lawful Data Collection
You represent and warrant that:
- You have obtained all necessary consents, authorizations, and legal bases to collect and process all Customer Data
- Your collection and use of personal data complies with Moroccan Law 09-08 and all applicable laws
- You have provided appropriate privacy notices to individuals whose data you process
- You have not collected data through deceptive, fraudulent, or unlawful means
4.2 Data Accuracy and Integrity
You are responsible for:
- Ensuring the accuracy, completeness, and integrity of Customer Data
- Verifying all data before relying on it for business decisions
- Correcting inaccurate or outdated data
- Not inputting false, misleading, or fraudulent data
4.3 Account Security
You must:
- Maintain the confidentiality and security of your account credentials
- Use strong, unique passwords and enable multi-factor authentication if available
- Promptly notify Wellys Pharma of any suspected unauthorized access or security breach
- Ensure that all users accessing the Service through your account comply with this Policy
- Monitor user activity and restrict access as appropriate
4.4 Compliance with Laws
You are solely responsible for:
- Understanding and complying with all applicable laws and regulations
- Obtaining necessary licenses, permits, and regulatory approvals
- Maintaining professional standards and ethical obligations
- Ensuring your use of the Service does not violate any laws
4.5 Independent Backups
You must maintain independent backups of all Customer Data. The Company has no obligation to preserve, back up, or provide access to data.
5. MONITORING AND ENFORCEMENT
5.1 Right to Monitor
Wellys Pharma reserves the right, but has no obligation, to:
- Monitor use of the Service for compliance with this Policy
- Investigate suspected violations or security incidents
- Access, review, or analyze Customer Data if necessary to enforce this Policy or comply with legal obligations
- Implement automated systems to detect prohibited conduct
5.2 Enforcement Actions
Upon violation of this Policy, Wellys Pharma may, in its sole discretion and without prior notice:
- Issue warnings or require corrective action
- Suspend or restrict access to specific features or functionality
- Suspend or terminate your account immediately
- Delete or remove prohibited content or data
- Report violations to law enforcement authorities or regulatory agencies
- Pursue legal action and seek damages, injunctive relief, or other remedies
- Cooperate with law enforcement investigations
5.3 No Obligation to Enforce
Wellys Pharma has no obligation to monitor use of the Service or enforce this Policy. Failure to enforce any provision does not constitute a waiver of our rights.

6. CONSEQUENCES OF VIOLATIONS
6.1 Immediate Termination
Serious violations may result in immediate account termination without refund or advance notice, including but not limited to:
- Illegal activities or facilitation of crimes
- Security breaches or cyberattacks
- Data theft or unauthorized access
- Resale of the Service without authorization
- Repeated or egregious violations
6.2 Legal Action
Wellys Pharma reserves the right to pursue all available legal remedies for violations of this Policy, including:
- Civil lawsuits for damages, injunctive relief, or specific performance
- Criminal complaints to law enforcement authorities
- Reporting to regulatory agencies (CNDP, pharmacy regulators, etc.)
- Referral to professional licensing boards
6.3 No Refunds
Termination or suspension due to Policy violations does not entitle you to any refund of fees paid. You remain liable for all fees incurred prior to termination.
6.4 Cooperation with Authorities
The Company will cooperate with law enforcement investigations and comply with legal requests for information related to Policy violations.
7. DISCLAIMER OF LIABILITY
7.1 No Liability for Customer Conduct
Wellys Pharma is not liable for:
- Violations of this Policy by Customers or their users
- Illegal or harmful conduct by users
- Damages arising from unauthorized access or data breaches
- Customer non-compliance with laws or regulations
7.2 Customer Indemnification
You agree to indemnify and hold harmless Wellys Pharma from all claims, damages, losses, and expenses arising from:
- Your violation of this Policy
- Your use of the Service
- Your collection or processing of personal data
- Claims by third parties related to your conduct

8. CHANGES TO THIS POLICY
Wellys Pharma reserves the right to modify this Policy at any time. Changes will be effective upon:

The prohibited uses listed in this Policy are not exhaustive. Wellys Pharma reserves the right to determine, in its sole discretion, whether conduct violates this Policy.
